Adult Store Sues County Over Ordinance

KANSAS CITY, Mo. — Owners of a controversial adult entertainment center have filed a federal lawsuit to overturn a county ordinance passed in January that places restrictions on adult entertainment venues.The lawsuit filed by Erotic City — located in Blue Summit, an unincorporated community between Kansas City and Independence — says Jackson County’s ordinance is vague, overly broad and unconstitutional.

“A portion of Erotic City’s stock-in-trade consists of sexually explicit material that is presumptively protected by the First and Fourteenth Amendments to the U.S. Constitution,” states the lawsuit, filed by Independence lawyer Sharlie Pender.

The suit asks that the ordinance be struck down and that Erotic City be reimbursed for legal fees, lost profits, loss of reputation and other damages. The court also is asked to issue a permanent injunction to keep the county from enforcing the new law.

County Executive Mike Sanders, a former county prosecutor who proposed the ordinance, said he was not surprised at the lawsuit but expects the ordinance will be upheld.

“We think what we did was incredibly reasonable, that it walks that fine line between protecting freedom of expression and protecting the public,” Sanders said.

The ordinance bans locked doors on video booths as well as any sex or sex solicitation in the booths. It outlaws physical contact between dancers and customers and requires employees to be licensed and to undergo criminal background checks.

Erotic City shut down its 26 video booths and discontinued nude dancing in its non-alcoholic bar after the ordinance passed. The shop continues to sell adult films, magazines and novelties.

Although the ordinance affects any business in unincorporated Jackson County, it was instigated by incidents at Erotic City. A man pleaded guilty in federal court late last year on charges of having sex with a 14-year-old girl at Erotic City and elsewhere.

The county sheriff’s office has said that Erotic City generated 115 calls to law enforcement since 2004 for offenses including assaults, car thefts and property damage by customers or others at Erotic City or in the immediate area. Erotic City was not charged with any offenses.

NR Media Moves to Amend Lawsuit Against Too Much Media

TRENTON, N.J. — NR Media Inc. (NRM) has filed a motion to amend its complaint in its lawsuit against Too Much Media (TMM), and to create a “hybrid” class action against the company, two of its directors and other parties.In the proposed amended complaint filed yesterday in the U.S. District Court in Trenton, NRM stated a wide variety of claims, including violations of New Jersey’s Consumer Fraud Act, negligent misrepresentation, misappropriation/conversion of confidential and proprietary information, breach of contract, violations of the New Jersey Identity Theft Protection Act, trade libel and other causes of action. The complaint names TMM, its owners John Albright and Charles Berrebbi, Fred Schank and 30 “John Does” as defendants.

The complaint alleged that the security breach that was confirmed by TMM in December was not a “breach” at all, but part of an intentional misappropriation of TMM’s client data undertaken with the knowledge and consent of TMM.

The complaint alleged that Fred Schank, a man allegedly identified as the individual behind the NATS breach, was not a third-party hacker but an “agent, employee and/or representative of” TMM.

“Schank, either in his individual capacity or as an agent, employee and/or representative of the TMM defendants, unlawfully accessed, copied, and misappropriated and converted the personal information and proprietary information stored on the servers of NRM and the members of the class for benefit of himself and/or the TMM defendants,” NRM alleged in its complaint.

The complaint also alleged that TMM has also failed to disclose defects in the NATS software, including that “NATS does not calculate commissions reliably and accurately” and that the NATS’ biller admin “does not interface effectively with all processors, resulting in the under-reporting of sign-ups and rebills” and that “underreporting of rebills has been a chronic problem with CCBill, Electracash, Netbilling, and other processors.”

TMM cofounder John Albright told XBIZ that he had no immediate comment on NRM’s motion to file an amended complaint, but said that the company would likely put out an official statement in response on Thursday.

‘Bama Senators Take Aim at “Sally D” Sold at Adult Video Stores

OPELIKA — A pair of Alabama senators have a little ‘sage’ advice for the state’s legislature concerning a relatively new player on the drug scene. Make it illegal.

If State Sens. Hank Erwin, R-Montevallo, [pictured] and Roger Bedford, D-Russellville, have their way, a type of plant called salvia divinorum, a powerful, psychoactive herb, will be classified as an illegal drug and carry with it the same penalties as marijuana.

“But this drug is much stronger than marijuana from what I understand,” said Bedford. “Police are catching kids with this drug but aren’t able to do anything because this stuff isn’t illegal.

“It’s another classic case of the law having to catch up with the drug trade,” Bedford said. “Who would have thought Sudafed would be a key ingredient in Methamphetamine that we’d have to keep behind the counter, but we passed a law that done exactly that.”

Salvia is known by more popular nicknames such as “Sally-D” and “Ska Pastora.”

Salvia divinorum extracts can be purchased online in extracts of 5x, 10x, 15x and 20x (the higher the number, the greater the strength of the extract).

“The plant is native to the Mexican state of Oaxaca and, like most salvias, should grow best in the full sun in reasonably dry and hot conditions,” said Gary J. Keever, professor with Auburn University’s Department of Horticulture. “Information indicates that the plant has been used in the past by the Mazatec Indians of Oaxaca as an aid in ritual divination.”

Salvia is classified in the mint family of plants. Some of the first live specimens of Salvia were cultivated in the early 1960s, Keever said.

“Some experts believe this plant may be the intentional or unintentional genetic cross between two different species because the plant exhibits low seed viability,” said J. Raymond Kessler, associate professor with the AU Department of Horticulture.

Whatever its composition, Bedford thinks the potential for abuse of the herb is high.

Some lobbyists for salvia are trying to have the herb in the mint family age-regulated, meaning that it wouldn’t be criminal to possess the herb if you were old enough.

Bedford says a bill is out of committee in the state Senate and hopes to see it passed before the legislative session ends this May.

“I don’t think Alabama has any place for this drug in its society,” Bedford said.

Sunset Thomas Gets Bounced From Roller Derby

LAS VEGAS — Adult performer Sunset Thomas has been banned from presenting the 2007 championship trophy at a roller derby event scheduled for April 19, between the Bay City Bombers and the Brooklyn Red Devils.Just last week, Thomas announced she had been invited by American Roller Skating Derby (ARSD) President Dan Ferrari to present the trophy to the Bay City Bombers, who are the current champions.

However, a backlash of disapproval from the roller derby community has caused Thomas to be banned from the event after the ARSD received hate mail and threats in protest of the adult star’s appearance.

“I thought it sucked because no one was giving me credit for being a sports personality on VavoomTV.com with my ‘Hottie Handicapper’ show,” Thomas said.

“I have provided sex advice for Esquire Magazine, starred in HBO’s hit series ‘Cathouse’ and just last week, I was giving out boxing’s Female Lightweight Championship of the World belt to Layla McCarter after her knockout performance at the Orleans [Casino] —right here in Vegas. The opposition to my attendance is based on bias, prejudice and ignorance.”

Thomas has interviewed many well-known sports personalities, as well as appearing at several sporting events. She also made national news when a thoroughbred racehorse was named for her.

Negative response followed shortly after Thomas received the invitation to present the trophy, when Brooklyn Red Devils general manager Georgia Hase was interviewed on “The Hottie Handicapper,” and objected strongly to Thomas’ appearance at the event. Old School Derby Association banked track manager and Corpus Christi Rolling Thunder owner Rose Colombo led the protest, writing an open letter to Ferrari that stated, “I would venture to say many will see your current promotional plan as being hypocritical at best, and just plain unacceptable and disrespectful of the sport, at worst.

“I urge you to re-think your new affiliation with the pornography trade,” Colombo added. “You risk further alienation and ridicule of the entire roller derby community by your shameful actions.”

Thomas’ husband and Vavoom Media vice president Kent Wallace told XBIZ, “[Colombo] is making a lot of judgments as to what is appropriate. The roller derby people, much like carnies, have always been outcasts in society and looked at questionably by most of mainstream society, just as adult performers are.

“If anything, they have an awful lot in common as far as being misunderstood and quickly judged,” Wallace added. “So, there’s a great irony, in my opinion. I could understand if it was Sunset singing the National Anthem at the World Series, maybe. Nonetheless, this is not Mom and America and apple pie — it’s roller derby.”

Bay City Bombers webmaster Tim Patten, who is also an associate of Ferrari, said that he also sees parallels between roller derby and adult entertainment. Though he has been involved in roller derby since the early ‘70s, Patten would like to see the sport updated to include new role models for women.

“It’s always been on the fringe, a very outlaw type thing, and it’s never really been mainstream,” Patten said. “Even though I think a lot of the fans would like it to be mainstream and respectable —it always is on the lunatic fringe.

“It’s always been all about women’s empowerment and changing the perspective toward women in our society,” Patten explained. “It was always pushing women’s role models in terms of athletes, back when women weren’t athletes. I personally think that Sunset represents a new role model for women who want to have an independent career.”

Though Patten pointed out that much of the protest coming from the roller derby community was based on ensuring that the event would remain suitable for families with young children, he said also that Thomas would be there only to present the trophy and sign autographs, and that she would be fully clothed.

He attributed much of the opposition to wild rumors that said Thomas might skate around the track naked, and also said that many of the athletes might feel jealous of Thomas’ stealing some of the attention from the event.

Colombo, who was contacted through her MySpace page, issued a short statement saying, “Thank you for your interest, but I have clearly stated how I feel about the situation and there really isn’t anything else to add.”

Two Sentenced in Pro Wrestler ‘Hardbody Harrison’s Sex Ring

ATLANTA — Two people were sentenced Thursday for taking part in a sex trafficking ring run by former professional wrestler “Hardbody” Harrison Norris.

Two others were sentenced for lying to investigators in the case.

U.S. District Judge Jack T. Camp sentenced Cedric Jackson, 41, of Atlanta to five years in prison and Aimee Allen, 37, formerly of Cartersville and now of Clarence, N.Y., to two years and 10 months for conspiracy to engage in sex trafficking.

Leslie Smith, 22, of Macon and Michell Achuff, 25, of Lafayette, Tenn., who admitted that they provided false information to protect Norris, each received three years of probation.

Norris, who claimed he just ran training camp for women to become professional wrestlers, was convicted by a federal jury on 24 counts related to sex trafficking, peonage, forced labor and witness tampering. His sentencing is scheduled for April 1.

According to information presented in court, Jackson admitted to working as a pimp in the Atlanta area and helping Norris bail unsuspecting women out of local jails and using those debts to coerce them to work as prostitutes.

Allen admitted that that since 2001, she helped Norris recruit women, many of whom were poor, homeless or addicted to drugs, to be prostitutes, by first convincing them that Norris would help them to become wrestlers.

Dave Pounder Praises Planned Parenthood

CNSNews.com) – David Mech, or David Pounder as he’s known in pornography circles, said that Planned Parenthood’s Web site for teens, Teenwire.com, is an excellent source for young people to learn about what he considers the benefits of viewing pornography.

Mech contacted Cybercast News Service after reading its report about Teenwire.

“Planned Parenthood is an excellent organization that helps people by focusing on how people actually are behaving (i.e., having sex, watching porn, doing drugs, etc.), as opposed to helping people based on how they should be behaving (abstaining from sex, watching the news, eating healthy, etc.),” Mech, a pornography producer and actor, told Cybercast News Service.

“Men in their teens are accessing porn, and I think it’s a normal thing,” he said.

Mech, who said he was first exposed to pornography at 13 or 14 through a friend, agrees with Planned Parenthood’s approach of promoting pornography “as an alternative to having sex,” especially if Teenwire.com’s advice on “outercourse” helps reduce sexually transmitted diseases and unwanted pregnancies.

He added that in today’s society, where young people are encouraged to earn a college degree before marriage, Teenwire.com is providing content, including tips on viewing pornography that modern teens need.

“It used to be that people got married at 13 or 14 years old,” Mech said. “It’s unrealistic (today) to expect people not to have sex before marriage.”

That’s why, Mech said, sex education shouldn’t rely on an abstinence-only approach.

“I think teens are going to have sex regardless,” Mech said. “Comprehensive sex education is the way to go, and if pornography is included as part of the program, that’s okay.

“Planned Parenthood is doing an exceptional job,” Mech said.

John Haney, psychotherapist with Crossroads Counseling and Associates in Austin, Texas, has worked with many teens and adults who have compulsive sexual disorders. He disagrees with Mech that viewing pornography is a good way to learn about human sexuality.

“It’s normal for (teenage) boys to have an interest in sex, but it’s not healthy for them to explore it that way,” Haney told Cybercast News Service. “I think if a teen is turning to pornography to get information about sexuality, they are going to get a distorted and incomplete view.”

Distorted, he said, because most pornography depicts male domination and women as sexual objects rather than human beings, and incomplete, because sexual acts aren’t put into perspective.

“(Pornography) completely neglects the emotional aspects of intimacy,” Haney said. “There is more to sex than the physical aspect.”

He added that viewing pornography also give teens – especially young girls – an unrealistic and even destructive way of viewing themselves and their sexuality.

Mech claims that even if pornography is still a taboo in today’s society, it is accepted as mainstream – and harmless – by most people.

“For every one person addicted to pornography there are a thousand people who view pornography responsibly,” Mech told Cybercast News Service.

Haney said teens should be taught that sex is a normal and a “God-given” fact of life, but that responding to their interest in the topic requires more than relying on the kind of advice found on Teenwire.com. For instance, the Teenwire Web site includes the following:

“There are a few things you should know about the images you might see. First of all, many people enjoy pornography alone or with a partner as part of sex play. People have different ideas of what is arousing, and there are many different kinds of porn that appeal to people’s different interests.”

“Curiosity about sex is normal,” Haney said. “And we shouldn’t shame kids about an interest in sex, but I don’t think pornography is the way to educate them.”
